1. Introduction
Welcome to Lucid Expeditions (“Lucid Expeditions,” “we,” “us,” or “our”).
Lucid Expeditions is a “doing business as” (DBA) name of Kroll Consultancy LLC, a limited liability company registered in the United States.
These Terms of Service (“Terms”) govern your use of the website lucidexpeditions.com and your participation in the Sardine Run expedition organized by Lucid Expeditions.
By accessing our website, submitting an inquiry, making a booking, or participating in an expedition, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Scope of Services
Lucid Expeditions exclusively offers participation in a Sardine Run marine wildlife expedition in South Africa.
Lucid Expeditions charters the entire expedition vessel from a licensed local tour operator and resells individual participant spots. We act as the expedition organizer and coordinator, working with independent third-party operators, including but not limited to vessel owners, captains, guides, and accommodation providers.
Our services include:
Chartering and coordination of the expedition vessel
Trip planning and logistics
Communication of schedules, requirements, and safety information
Coordination of professional photo and video media captured during the expedition
Lucid Expeditions does not control natural conditions and does not guarantee wildlife sightings, sea conditions, weather, or specific experiences.
3. Booking and Payment Terms
3.1 Booking Confirmation
A booking is confirmed only after:
Receipt of the required deposit, and
Written confirmation from Lucid Expeditions
Submitting an inquiry does not guarantee availability.
3.2 Payment Schedule
All prices are communicated at booking and quoted in euros (EUR), unless otherwise stated.
The payment schedule is as follows:
€600 non-refundable deposit due at booking
50% of the remaining balance due by December 31, 2025
Final 50% of the remaining balance due by January 31, 2026
Failure to make payments by the stated deadlines may result in cancellation of your booking without refund of amounts already paid.
4. Cancellation and Refund Policy
4.1 Cancellations by You
All cancellation requests must be made in writing.
Refunds are issued according to the following schedule:
Until December 31, 2025:
100% refund of amounts paid excluding the €600 non-refundable depositFrom January 1, 2026 to February 28, 2026:
30% refund of amounts paid excluding the €600 depositFrom March 1, 2026 onward:
No refunds will be issued
No refunds are provided for late arrival, early departure, unused services, or dissatisfaction with wildlife sightings or conditions.
4.2 Cancellations or Changes by Us
Lucid Expeditions reserves the right to cancel, postpone, or modify the expedition due to weather, safety concerns, mechanical issues, operator availability, force majeure events, or other circumstances beyond our control.
In such cases, Lucid Expeditions may, at its discretion:
Offer an alternative expedition date, or
Refund payments received, excluding unrecoverable third-party costs
5. Nature of the Experience & Wildlife Disclaimer
The Sardine Run is a natural marine wildlife event. Animal behavior, sightings, and interactions cannot be predicted or guaranteed. No specific species, quantity, or proximity of wildlife encounters is promised.
Changes to itinerary, duration, or daily activities due to environmental or safety considerations do not constitute grounds for refunds or claims.
6. Health, Fitness, and Safety
Participation involves inherent risks, including but not limited to:
Open-ocean swimming
Boat transfers
Strong currents and variable sea conditions
Interaction with wild marine animals
Participants must:
Be confident swimmers
Be physically capable of marine activities
Follow all safety instructions provided by guides, crew, and operators
You are required to disclose any medical conditions, injuries, or limitations that may affect participation. Lucid Expeditions reserves the right to refuse or terminate participation if deemed necessary for safety.
7. Travel Insurance (Mandatory)
All participants are required to carry comprehensive travel insurance covering:
Marine activities (including snorkeling and freediving)
Medical treatment and emergency evacuation
Trip cancellation and interruption
Proof of insurance may be requested prior to departure. Participation may be denied without adequate coverage.
8. Assumption of Risk & Liability Waiver
8.1 Assumption of Risk
By participating, you acknowledge and voluntarily accept the inherent risks associated with marine wildlife expeditions and open-ocean activities.
8.2 Limitation of Liability
To the fullest extent permitted under applicable US law, Lucid Expeditions shall not be liable for any injury, illness, loss, damage, delay, or expense arising from:
Participation in the expedition
Acts or omissions of third-party operators
Environmental or wildlife-related events
8.3 Indemnification
You agree to indemnify and hold harmless Lucid Expeditions from any claims, damages, losses, or expenses arising from your participation or violation of these Terms.
9. Media & Content Usage
Participation includes professional photo and video media captured during the expedition.
By participating, you grant Lucid Expeditions a worldwide, royalty-free, perpetual license to use images and video featuring you for marketing, promotional, editorial, and commercial purposes, unless you explicitly opt out in writing prior to the expedition.
Lucid Expeditions makes no guarantee regarding the quantity, timing, or specific content of media delivered.
10. Intellectual Property
All website content, branding, expedition materials, and media produced by or for Lucid Expeditions remain the intellectual property of Lucid Expeditions unless otherwise stated.
11. Privacy
Personal data is processed in accordance with our Privacy Policy.
12. Modifications to Terms
Lucid Expeditions reserves the right to modify these Terms at any time. Updates take effect upon publication on the website.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the state or federal courts located in that jurisdiction.
